These Terms of Service ("Terms") govern your access to and use of the Caveist platform, including our website, applications, and AI-powered wine cellar management services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Caveist is an AI-powered wine cellar management platform that enables users to catalogue, track, and manage their wine collections through natural language interaction. The Service provides features including, but not limited to, wine bottle inventory management, label recognition, tasting note logging, drinking window recommendations, food pairing suggestions, and cellar analytics.
Caveist operates as a Model Context Protocol (MCP) server, designed to integrate with compatible AI assistants. The quality, accuracy, and availability of AI-generated recommendations depend on third-party AI providers and are offered on an as-is basis.
2. Account Creation and Responsibilities
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials, including any API tokens or bearer tokens issued to you;
- All activity that occurs under your account, whether or not authorized by you;
- Notifying Caveist immediately at support@caveist.com of any unauthorized use or security breach.
You must be at least 16 years of age to create an account. By registering, you represent that you meet this age requirement.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to store, transmit, or process any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable;
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service;
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
- Reverse engineer, decompile, or disassemble any aspect of the Service;
- Use automated systems (bots, scrapers, or similar) to access the Service beyond the intended MCP integration;
- Resell, sublicense, or redistribute access to the Service without written authorization from Caveist;
- Use the Service to promote the sale of alcohol to minors or in violation of applicable alcohol regulations.
4. Intellectual Property
The Service, including its design, software, algorithms, branding, documentation, and all related intellectual property, is and remains the exclusive property of Caveist. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
You retain full ownership of the data you input into the Service, including your cellar inventory, tasting notes, and personal preferences. By using the Service, you grant Caveist a limited, non-exclusive license to process this data solely for the purpose of providing and improving the Service.
5. Data and Privacy
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
You are solely responsible for ensuring that any data you input into the Service does not infringe on the rights of any third party.
6. Subscription and Payment
Access to the Service requires a paid subscription. Subscription plans, pricing, and included features are as displayed on the Caveist website at the time of purchase.
Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). You authorize Caveist to charge the payment method on file for all applicable fees.
Unless you cancel your subscription before the end of the current billing period, it will automatically renew under the same terms. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
Caveist reserves the right to modify pricing with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Caveist and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.
The Service provides AI-generated recommendations regarding wine storage, drinking windows, and food pairings. These recommendations are informational only and should not be relied upon as professional advice. Caveist does not guarantee the accuracy of AI-generated content and accepts no liability for decisions made based on such recommendations.
In no event shall Caveist's total aggregate liability exceed the amounts you have paid to Caveist in the twelve (12) months preceding the event giving rise to the claim.
8. Termination
You may terminate your account at any time by contacting support@caveist.com or through your account settings.
Caveist reserves the right to suspend or terminate your account, without prior notice, if you breach these Terms or engage in conduct that Caveist reasonably determines to be harmful to the Service, other users, or third parties.
Upon termination, your right to access the Service ceases immediately. You may request an export of your data within 30 days of termination, after which Caveist may delete your data in accordance with its data retention policies and applicable law.
9. Modifications to Terms
Caveist reserves the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least 30 days before taking effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and close your account.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the French Republic, without regard to its conflict of laws provisions.
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France, subject to any mandatory consumer protection provisions that may apply under European Union law.
11. Miscellaneous
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Caveist's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Caveist regarding the Service.
